These Legal Disclaimers, the Terms and Conditions of use and the Privacy and Security policies are the policies of B.A.F.E Group LLC (“B.A.F.E Group”) that apply to your use of this website, and they govern your use of the Website. The terms "we", "us" or "our" refer to B.A.F.E Group, and the terms "you" and "your" refer to you, a home-buying customer.


Amenities

Existing and proposed amenities for the communities are subject to changes, substitutions and/or deletions without notice. B.A.F.E Group makes no representation or guarantee that the communities or any amenities will be built out as currently planned.

Booking by Appointment

Booking an appointment on this website does not constitute a realtor registration. For more information, please see your B.A.F.E Group New Home Consultant. Booking by appointment is not an offer to sell a home; any such agreement may only be made in writing signed by both the seller and the purchaser.

Broker Participation Policy

In order for a participating cooperating real estate brokerage (“Cooperating Broker”) to receive a commission in connection with the sale of real property, the Cooperating Broker must register a prospective buyer (the “Prospect”) before the Prospect: (i) is introduced to the Community via the internet; (ii) visits the Community; and/or (iii) attends a self-guided tour of the Community. Phone registrations will not be accepted. Cooperating Broker, or its affiliated sales associate, must also accompany the Prospect during Prospect’s initial visit or initial self-guided tour of a home in a community. If the tracking system used at the sales office for a community indicates that the Prospect was initially introduced to the community via the internet, initially registered at the sales office and/or attended a self-guided tour of the Community without being accompanied by Cooperating Broker or its affiliated sales associate, neither Cooperating Broker nor its sales associate shall be entitled to receive a commission in connection with the sale of real property in the community to such Prospect. Cooperating Broker should confirm the effective period of any Prospect registration with the New Home Consultant that is assisting the Cooperating Broker. Additional terms and conditions may be required by Lennar’s individual homebuilding divisions. Any payment of commission shall require a written Cooperating Broker Agreement be first executed between B.A.F.E Group and the Cooperating Broker setting forth the amount of the commission and any additional terms and conditions. The Cooperating Broker Agreement shall be null and void if Cooperating Broker or its sales associate have violated the terms of the Broker Participation Policy. In addition to any other conditions set forth in the Cooperating Broker Agreement, in order for Cooperating Broker to be eligible to receive a commission, the Prospect must (i) properly register with the Cooperating Broker in compliance with the timing and other requirements of this Broker Participation Policy, (ii) contract to purchase a home from the on-site sales staff in the community before the expiration of the Registration Period, and (iii) close on the purchase of the Home pursuant to the Purchase and Sale Agreement. This registration, or any extension thereof, does not protect Cooperating Broker from another cooperating broker or broker registering the same Prospect with B.A.F.E Group. In all cases, Cooperating Broker shall be solely responsible for payment of any commission to its sales agents. The registration forms, sign-up sheets and other incentives, contracts, or forms given to Prospects or buyers of homes are trade secrets of B.A.F.E Group.

Completion Date

Unless otherwise noted in your purchase agreement, B.A.F.E Group is required to complete, and does agree to complete, the construction of your home within a period of two (2) years from the date you sign your purchase agreement. If construction is delayed by any event recognized by the law of the state where your home is located as a defense to a contract action for non-performance or delay in performance, then the date of completion shall be extended by the delay period. It is expressly intended that your and B.A.F.E Group’s rights and obligations under your purchase agreement be construed in the manner necessary to exempt your purchase agreement and the sale of your home from registration under the Interstate Land Sales Full Disclosure Act, and both you and B.A.F.E Group expressly waive any right or provision of the purchase agreement that would otherwise preclude such exemption.

Closing Cost Incentive

Offers for closing cost incentives are only available on select B.A.F.E Group homes. Buyer may be required to sign a purchase agreement or close by a certain date to be eligible for a closing cost incentive. B.A.F.E Group will provide the buyer the credit at closing. The amount of the credit is subject to lender approval. Offers, incentives and seller contributions are subject to certain terms, conditions and restrictions. Certain incentives could affect the loan amount. B.A.F.E Group reserves the right to change or withdraw any offer at any time. Offer may require financing through seller’s affiliate B.A.F.E Group Mortgage, but use of B.A.F.E Group Mortgage is not required to purchase a home.

Energy Savings

Energy calculations and claims are estimates only, and were developed by third parties and not based on B.A.F.E Group home designs. Savings will vary due to many variables, including but not limited to, actual utility rates and fees, actual construction, floor plan, occupancy, appliance usage, thermostat settings, weather conditions, number of individuals occupying the home and orientation of the home. B.A.F.E Group provides no guarantee of savings or efficiency that will be achieved by each homeowner.

A purchaser should not rely on these estimates of retail value in making their purchase decision and should make their own inquiries as to the costs of such items. The specific features in a home may vary from home to home and from one community to another. We reserve the right to substitute equipment, materials, appliances, and brand names with items of equal or higher value, in our sole opinion. Color and size variations may occur. The prices of our homes, included features, and available locations are subject to change without notice. B.A.F.E

B.A.F.E Mortgage

Some offers require financing through B.A.F.E's affiliated lenders, B.A.F.E Mortgage, LLC (“B.A.F.E Mortgage”), but use of B.A.F.E Mortgage is not required to purchase a home. See Affiliated Business Arrangement Disclosure for B.A.F.E Mortgage.

When financing through B.A.F.E Mortgage, specific terms will apply and if the buyer is financing the purchase of the home, the buyer is subject to qualification including without limitation, minimum down payment, credit score, owner occupancy requirements, employment requirements and/or any investor guidelines or programs.

Requesting a loan prequalification and making a loan application do not constitute a loan approval or otherwise indicate that a consumer has or will qualify for a loan from B.A.F.E Mortgage or any other lender. Prequalifying with B.A.F.E Mortgage is voluntary and is not required in order to obtain a loan from B.A.F.E Mortgage and/or purchase a home from B.A.F.E Group or any of its affiliated homebuilders. Prequalification does not (a) constitute a loan approval or indicate that you have or will qualify for a loan from B.A.F.E Mortgage or any other lender; or (b) guarantee you will qualify to purchase a B.A.F.E home. B.A.F.E Mortgage’s Home Buyer Solutions Group (HBSG) is a voluntary program and participation is not required in order to obtain a loan from B.A.F.E Mortgage and/or purchase a home from B.A.F.E Group LLC or any of its affiliated homebuilders. Participants enrolling in HBSG are under no obligation to purchase a B.A.F.E home or obtain a mortgage loan from B.A.F.E Mortgage. Participation in or completion of the HBSG program does not (a) constitute a loan approval or indicate that the participant has or will qualify for a loan from B.A.F.E Mortgage or any other lender; (b) guarantee the participant will qualify to purchase a B.A.F.E home; or (c) guarantee any improvement of the participant’s credit rating or history. Upon enrollment, the participant must provide pertinent financial information and must authorize HBSG to obtain and analyze the participant’s credit report. Completion of the HBSG program averages 90 to 120 days from the day of entry in the program.

The Connected Home by B.A.F.E

B.A.F.E reserves the right to substitute with a device of equal or better quality. B.A.F.E does not guarantee any equipment or services provided by Ring, eero, Flo by Moen (including equipment/services relating to the detection of leaks), Level, Chamberlain Group, Inc., Honeywell Home by Resideo, or other third parties. The eero whole-home wifi guarantee is limited to one year and based on whether a connected device in any internal room of the house or any attached patio space does not consistently receive signal of at least one bar as measured by the eero app, excluding causes outside of eero’s reasonable control. Homeowner is solely responsible for providing wifi internet connectivity, cellular services, and electric power needed to operate the products and utilize any associated apps; monitoring any alerts; and, configuring all security features. B.A.F.E does not warrant or represent that any network or device is secure or can prevent all privacy intrusions, malware, or cyber-attacks, even when correctly configured. Leak detection and shut off systems services do not monitor or otherwise detect leaks in the fire sprinkler line or lines connected thereto. We urge prospective purchasers to look at our model homes and inquire of our previous purchasers to determine if our measurement of Zero Defects / Six Sigma is satisfactory.
